[lawsuit_or_court - owner vs board dispute / oppression] An owner withheld condo fees and counterclaimed to invalidate rental regulations (requiring credit/criminal checks for tenants, June-October 2010) as contrary to the Condominium Property Act and oppressive; the Master granted the condo corporation summary judgment for unpaid fees, found the rental regulations contrary to s.32(5) of the Act but ruled no damages or oppression were proven, dismissed the counterclaim, and awarded costs under Schedule C Column 1. (2015-04-29); [lawsuit_or_court - bylaw enforcement (pets, rentals, noise, smoking, renovations, short-term rentals)] An owner challenged condo rental regulations requiring tenant credit/criminal checks and $1,000,000 tenant liability insurance as unlawful under the Condominium Property Act. The court found damages claims time-barred under the Limitations Act and the economic tort not established, but declared the tenant liability insurance requirement unlawful and of no force or effect, awarding costs to the owner.
