(2009-08-20); [lawsuit_or_court - bylaw enforcement (pets, rentals, noise, smoking, renovations, short-term rentals)] A condominium corporation sought to evict an owner for repeated noise nuisance (door and cupboard slamming) in breach of bylaw 62(b); the Court of Appeal held the chambers judge erred in finding eviction unavailable under s. 67(2)(f) of the Condominium Property Act, but on the record eviction was not justified, so it instead ordered the owner to cease making noise that unreasonably interferes with other units, leaving further remedies open if breached.
